Terms of Service
Effective 22 October 2026
These Terms of Service (“Terms”) govern the provision of services by Local Dumpster Pro (“Local Dumpster Pro”, “we”, “us” or “our”) to you (“Customer” or “you”). By requesting an estimate, booking work, or permitting us to perform work at a property, you agree to these Terms.
1. The Services
Local Dumpster Pro provides junk removal, hauling, property cleanout and roll-off container rental services in southwest Ohio (the “Services”). We perform the Services using our own personnel and equipment.
2. Subcontracted work
Where we are unable to perform a particular job ourselves, whether by reason of scheduling, capacity, equipment, distance or the nature of the materials, we may engage a qualified subcontractor to perform that job on our behalf. We select and vet the subcontractors we work with and we remain your point of contact throughout.
Subcontractors are independent businesses. They are not employees, partners, agents or joint venturers of Local Dumpster Pro, they direct the manner and means of their own work, and they maintain their own insurance and licences. Nothing in these Terms creates an employment, agency or partnership relationship between Local Dumpster Pro and any subcontractor.
3. Estimates, quotations and pricing
Junk removal and hauling are priced by volume, being the space the materials occupy in the vehicle, and not by hour or by item. Container rental is priced by container size, the rental period included, and the tonnage allowance included.
An estimate is based on the description and any photographs you provide. It is an estimate only. Where the materials or site conditions differ materially from what was described, we will notify you of the revised price before performing the additional work, and you may accept it, reduce the scope, or cancel without charge for the portion not performed. We do not perform or charge for additional work without your prior authorisation, which may be given verbally, by text message or in writing.
Charges additional to the quoted price may apply for excess tonnage, extended rental days, materials requiring special handling or disposal, and return trips necessitated by circumstances outside our control. Where applicable these are disclosed at the time of booking.
4. Prohibited and restricted materials
We do not accept, and you must not place in any container or present for removal, the following: hazardous waste; asbestos or asbestos-containing materials; paints, solvents, adhesives, fuels, oils and other liquid chemicals; lead-acid and other vehicle batteries; pressurised cylinders including propane tanks; explosives or ammunition; medical, biological or infectious waste; radioactive materials; contaminated soil; animal carcasses; or any material the receiving disposal facility refuses to accept.
You are responsible for disclosing the presence of such materials. Where prohibited materials are discovered, we may refuse the materials, suspend work, or remove and dispose of them lawfully at your cost, and you are responsible for all resulting charges, fines, penalties and remediation costs. Where prohibited materials are placed in a container, you are responsible for any charge levied on us by the disposal facility.
5. Scheduling and arrival windows
You provide preferred dates. We confirm a date and a two-hour arrival window once a crew has been assigned. Arrival windows are estimates made in good faith. Traffic, weather, disposal facility queues and preceding jobs may cause variation, and we will keep you informed where a material delay arises. Time is not of the essence in the performance of the Services.
6. Site access and conditions
You warrant that you are the owner of the property or are authorised by the owner to instruct the Services, and that you are authorised to dispose of the materials presented.
You are responsible for providing safe, lawful and unobstructed access; for disclosing hazards, including unstable structures, animals, low cabling and overhead obstructions; for obtaining any permit required by a municipality or homeowners association for placement of a container on a street or common area; and for identifying private utilities, septic systems, irrigation, cabling and drainage in the area where a container is to be placed.
You acknowledge that delivery vehicles and loaded containers are heavy, and that driveways, kerbs, aprons, lawns, walkways and subsurface installations may be marked, cracked or damaged by their ordinary and proper use. We exercise reasonable care. To the extent permitted by law, we are not liable for damage to such surfaces or installations arising from placement at a location you have directed or approved, absent our negligence.
7. Title to materials, abandonment and salvage
Title to and risk in all materials removed by us passes to Local Dumpster Pro at the moment the materials are loaded. You represent that you have the right to transfer title, and that the materials are free of any lien or claim.
We may, at our discretion, recycle, donate, resell or otherwise dispose of materials removed. You retain no interest in materials once loaded and are not entitled to any proceeds. You are responsible for removing all items of value, documents, data storage media and personal effects before work commences. Local Dumpster Pro is not liable for the loss of any item included in materials presented for removal.
Materials left outside a container, or in excess of the volume or tonnage booked, may be refused or charged separately.
8. Payment
Payment is due at the time of booking unless otherwise agreed in writing. Payments are processed by a third-party payment processor. You authorise us to charge the payment method provided for the agreed price and for any additional charges you have subsequently authorised under Section 3.
When you pay, your card is kept on file with our payment processor. You authorise us to charge it later for changes to the Services that you approve, whether verbally, by text message, in writing or on your booking page, and for any fee set out in these Terms. We do not charge it for anything else. We tell you at the time of any such charge, with the reason and the amount.
Amounts not paid when due may bear interest at the lesser of one and one half per cent per month or the maximum rate permitted by law, together with the costs of collection including reasonable legal fees. You agree to raise any dispute with us directly under Section 13 before initiating a chargeback.
9. Cancellation and rescheduling
You may cancel or reschedule at no charge with at least twenty-four (24) hours’ notice before your confirmed arrival window. With less notice, the late cancellation fee in Section 10 applies. Where a crew arrives and cannot perform the Services for a reason within your control, the trip fee in Section 10 applies instead. We may cancel or reschedule where conditions render performance unsafe, unlawful or impracticable, and in that event your sole remedy is a refund of amounts paid for work not performed.
10. Fees
The following fees apply in the circumstances described, in addition to your quoted price, unless the item is already included in your quote. Each is charged to the card on file under Section 8, and we tell you at the time with the reason, the amount and, where relevant, a photograph.
| Fee | Amount | When it applies |
|---|---|---|
| Late cancellation | $100 | You cancel or reschedule with less than 24 hours’ notice. |
| Trip fee (dry run) | $150 | The crew or driver arrives and cannot perform the Services because access is blocked, unsafe or unavailable, nobody is present when required, or the materials or container are not ready as agreed. |
| Mattress or box spring | $100 each | Each mattress or box spring removed that was not included in your quote. |
| Tire | $25 each | Each tire, with or without a rim, removed that was not included in your quote. |
| Prohibited material in a container | $150 per item, plus any charge levied by the disposal facility | Prohibited material under Section 4 is placed in a container. |
| Container overweight | $100 per ton | The weight on the disposal facility’s ticket exceeds the tonnage allowance in your quote, charged pro rata to the tenth of a ton. |
| Container extra day | $25 per day | The container is kept beyond the rental period in your quote. |
Work outside the agreed scope is not covered by a fee. It is priced separately as a change order and performed only once you approve it under Section 3.
11. Junk removal
Our crew loads the materials agreed in your quote from the locations you have shown or described. Where the crew finds more, or different, materials than were described or photographed, they will tell you before loading them. You may approve a change order for the additional materials, or leave them.
Where the crew finds prohibited material under Section 4, it will be left on site and not loaded. No fee applies for material we leave. Mattresses, box springs and tires not included in your quote are charged under Section 10 if you ask us to remove them.
We sweep the area the materials were removed from. We do not clean, repair or restore surfaces beyond that.
12. Container rental
The rental period, container size and tonnage allowance are those in your quote. The rental period begins on the day of delivery. You must not move the container, load it above the top of its walls, light fires in or near it, or allow anyone else to place material in it without your permission. Material loaded above the walls must be removed before collection, or collection will not proceed and the trip fee in Section 10 applies.
Weight is determined by the ticket issued by the disposal facility, which we will provide on request. Weight above your allowance, days beyond your rental period and prohibited material in the container are charged under Section 10. You must keep the container and the route to it clear for delivery, exchange and collection; a visit that cannot be completed is charged as a trip fee.
You are responsible for the container while it is at your property, other than for ordinary wear, and for obtaining any permit under Section 6.
13. Claims
Any claim relating to the Services, including a claim of property damage or of work not performed, must be notified to us in writing within seven (7) days of the date of service, and you must permit us a reasonable opportunity to inspect before repair or alteration. Failure to give timely notice and opportunity to inspect waives the claim to the extent it prejudices our ability to investigate.
We maintain a photographic and timestamped record of work performed and will make the relevant record available to you. Where a claim arises from work performed by a subcontractor, we will provide that subcontractor's identity and insurance details and will assist you in presenting the claim to them.
14. Insurance
Local Dumpster Pro maintains insurance appropriate to the Services. Subcontractors are required to maintain their own insurance. Evidence of coverage is available on request.
15. Disclaimer of warranties
Except as expressly stated in these Terms, and to the maximum extent permitted by law, the Services and the Site are provided on an “as is” and “as available” basis, and Local Dumpster Pro disclaims all warranties, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade.
16. Limitation of liability
To the maximum extent permitted by law, Local Dumpster Pro shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, use, goodwill or business opportunity, howsoever arising and whether in contract, tort, strict liability or otherwise, even if advised of the possibility of such damages.
To the maximum extent permitted by law, the aggregate liability of Local Dumpster Pro arising out of or relating to a job shall not exceed the amount actually paid by you to Local Dumpster Pro for that job.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability which cannot lawfully be excluded or limited.
17. Indemnity
You agree to indemnify and hold harmless Local Dumpster Pro, its officers, employees and contractors, from and against any claim, liability, loss, damage, fine, penalty and expense, including reasonable legal fees, arising out of or relating to your breach of these Terms, your presentation of prohibited or misdescribed materials, your failure to obtain a required permit or authorisation, your failure to disclose a site hazard, or your lack of authority in respect of the property or the materials.
18. Force majeure
Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including severe weather, flood, fire, epidemic, labour disruption, fuel shortage, act of government, closure of a disposal facility, or failure of a communications or payment network.
19. Dispute resolution and arbitration
Please read this Section carefully. It affects how disputes are resolved and limits the manner in which you may seek relief.
The parties will first attempt in good faith to resolve any dispute by negotiation. Either party may initiate that process by written notice describing the dispute and the relief sought. If the dispute is not resolved within thirty (30) days, it shall be resolved by binding individual arbitration administered in accordance with the rules of a recognised arbitration provider, seated in Montgomery County, Ohio, and judgment on the award may be entered in any court of competent jurisdiction.
Either party may bring an individual action in small claims court in lieu of arbitration where the claim qualifies. Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
Class action waiver. Disputes shall be arbitrated only on an individual basis. Neither party may bring a claim as a plaintiff or class member in a class, consolidated, collective or representative proceeding, and the arbitrator may not consolidate the claims of more than one person. If this waiver is held unenforceable as to a particular claim, that claim shall proceed in court and all other claims remain in arbitration.
20. Governing law and venue
These Terms are governed by the laws of the State of Ohio without regard to conflict of laws principles. Subject to Section 19, the exclusive venue for any action is the state or federal courts located in Montgomery County, Ohio, and each party submits to their jurisdiction.
21. Site content and intellectual property
The Site, and all text, imagery, graphics, layout, software and other content on it, are owned by Local Dumpster Pro or its licensors and are protected by intellectual property law. You may not copy, reproduce, republish, scrape, frame or create derivative works from the Site without our prior written consent.
22. Communications
You consent to receive communications from us electronically, including by email and, where you have provided a mobile number, by text message in accordance with our Text Messaging Terms. Our Privacy Policy forms part of these Terms.
23. General
If any provision is held invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a corporate transaction. These Terms, together with the documents referenced in them and any written quotation, constitute the entire agreement between the parties in respect of their subject matter. We may amend these Terms by posting a revised version, and the version in force at the time work is booked governs that work.
